The prediction of legal judgments is one of the most recognized fields in Natural Language Processing, Artificial Intelligence, and Law combined. By legal prediction, we mean intelligent systems capable of predicting specific judicial characteristics such as the judicial outcome, the judicial class, and the prediction of a particular case. In this study, we used an artificial intelligence classifier to predict the decisions of Brazilian courts. To this end, we developed a text crawler to extract data from official Brazilian electronic legal (...) systems, consisting of two datasets of cases of second-degree murder and active corruption. We applied various classifiers, such as Support Vector Machines, Neural Networks, and others, to predict judicial outcomes by analyzing text features from the dataset. Our research demonstrated that Regression Trees, Gated Recurring Units, and Hierarchical Attention Networks tended to have higher metrics across our datasets. As the final goal, we searched the weights of one of the algorithms, Hierarchical Attention Networks, to find samples of the words that might be used to acquit or convict defendants based on their relevance to the algorithm. O artigo pretende contribuir com as discussões sobre o ensino de filosofia, partilhando achados de uma pesquisa realizada com duas turmas de estudantes universitários na disciplina de Estética (Curso de Música -Licenciatura). As inovações metodológicas aplicadas nas turmas buscaram valorizar o ensino de filosofia em diálogo permanente com as vivências cotidianas e artísticas dos estudantes através de atividades em sala sistematicamente vinculadas aos temas previstos no programa da disciplina. Os resultados dos dados apontaram que as estratégias metodológicas de ensino utilizadas (...) na disciplina tiveram impacto positivo para o engajamento dos discentes, atuando desenvolvimento de sua criticidade e criatividade. O artigo relaciona os elementos curriculares propostos por Hobbes no capítulo XXX do Leviatã com as leis naturais descritas nos capítulos XIV e XV. Metodologicamente, o trabalho conduz-se em 4 etapas: 1) listar os conteúdos educacionais explicitados no capítulo XXX; 2) buscar potenciais equivalentes de cada um dos conteúdos listados com aspectos das leis naturais presentes nos capítulos XIV e XV; 3) comparar os argumentos e questões teóricas pertinentes a essas equivalências potenciais; 4) destacar possíveis ampliações interpretativas oriundas da análise (...) comparativa realizada. Dada essa escolha metodológica, justifica-se a ausência de outras referências bibliográficas que não o Leviatã. Dentre os achados, sublinha-se que todos elementos curriculares presentes no capítulo XXX puderam ser articulados com, pelo menos, uma lei natural, merecendo destaque a maior ocorrência de vinculações com a terceira lei de natureza. ABSTRACTThe understanding of a wide array of practices related to fraud, bribery, corruption, and more widely, illicit practices have been capturing the attention of practitioners and management researchers worldwide. A substantial portion of the extant research has used university students to measure their actual or intended cheating behaviours and often studies have tested for variations across countries and cultures. We highlight some major concerns in this stream of inquiry and discuss both the definition and some inconclusive results in prior studies, (...) namely those deriving from differences in cheating behaviour across different cultural contexts. We suggest the need to examine intentionality, and further advance that intentionality may assume a reactive or a proactive essence. Depending on the social and formal contexts of different countries, both reactive and proactive intentions lead to distinct moral concerns, which we name in this work omorality or immorality. Em Totalidade e Infinito, Lévinas descreve cuidadosamente a separação do Mesmo e do Outro, recorrendo diversas vezes ao termo “ensinamento” para definir o acolhimento num Eu interior, daquilo que lhe é exterior. Mas para Lévinas, na absoluta alteridade, o outro é Outrem, outra pessoa, irredutível à minha posse, exterioridade absoluta que me encara a partir de um rosto, como um ser que me fala e, por isso, é o único capaz de me ensinar. Acolher outrem, nesse sentido, é responder-lhe e, (...) assim, ser responsável por ele, numa relação que é, essencialmente, ética. Com isso em mente, é possível refletir sobre o sentido mais profundo da relação educativa que, para além dos papéis que assumem professores e alunos numa totalidade sistemática, Eu e Outro constituem uma frente a frente que dá sentido ao mundo do qual vivem, se apropriam e compartilham. A relação entre os sujeitos na educação, portanto, extrai sua significação do ensinamento, não como prioridade de um conteúdo comunicável, mas como responsabilidade infinita por outrem, como relação ética. A partir da leitura da Fenomenologia do espírito [Phänomenologie des Geistes], de Hegel, em particular, da Introdução, busca-se elaborar os pressupostos da formação da consciência, mostrando os momentos em que essa passa pelo seu formar, diferentemente do que ocorria no período moderno. Percebe-se o surgimento de novo critério de formação, cujo fundamento é assinalado pela crítica que Hegel faz à formação representativa, que sustenta a educação mediante a interiorização do pensamento e a representa a partir de conceitos que não passaram (...) pela experiência com o objeto e nem realizaram a negação de seu saber com o intuito de formar outro. Já na formação dialética, a partir dos pressupostos hegelianos, a consciência sai do seu estado natural e percorre o movimento do círculo espiral e, em cada momento desse percurso circular, realiza a experiência entre o saber da consciência com a verdade do objeto. Nesse sentido, cada etapa dessa experiência é o aprofundar no saber da consciência e na verdade do objeto, causando dúvida e desespero em seu formar, pois vê desaparecerem o conhecer e a verdade que tinha do objeto. Com isso, têm-se os momentos de negação, de conservação e de superação tanto na consciência quanto no objeto, constituindo a suprassunção [Aufhebung] até alcançar o saber conceitual em que há a identificação entre o saber e a verdade. Com esse princípio de formação, Hegel faz a crítica da crítica e efetiva a experiência entre o saber do sujeito e a verdade do objeto. Nesse itinerário, a consciência, paulatinamente, entra no processo do trabalho de formação, cujo fundamento é o concrecere – crescer juntos; ou seja, o saber da consciência com a verdade do objeto. Isso se realiza no momento em que a consciência é tocada pelo fenômeno do objeto. Há, então, novo procedimento pedagógico que leva em consideração a negação, o ceticismo amadurecido e a experiência para alcançar o saber real de sua formação [Bildung]. Palavras-chave: Formação. Abordagem do protagonismo social, analisando sua relação com a informação, concluindo pela compreensão deste como objetivo do trabalho informacional, situando a mediação da informação como sua ação central. Parte da apresentação das origens conceituais em torno do protagonismo, buscando, à medida que debate as referências acerca do tema, demonstrar a relação do desenvolvimento do protagonismo social com o trabalho informacional, assim como sua posição de meta da atividade da mediação da informação, executada nas suas cinco dimensões e na condição de (...) elemento central desse trabalho. As assertivas apresentadas são resultado do estudo crítico da bibliografia da área da Ciência da Informação que aborda o protagonismo e a mediação da informação, assim como de estudos de filósofos e pensadores que abordam os aspectos sociais e políticos da comunicação e da formação de sujeitos socialmente ativos, permitindo a identificação das relações entre protagonismo e mediação da informação, como também que a mediação consciente favorece o primeiro, concluindo que o apoio ao seu desenvolvimento representa a principal responsabilidade social do trabalho com a informação. O artigo apresenta uma discussão acerca da percepção do imaginário da cultura africana e afro-brasileira e da construção da identidade étnico-racial no enredo escolar. A investigação foi realizada a fim de: 1- analisar os tipos de suportes e referenciais culturais que a escola fornece para a construção da identidade étnico-racial; 2- identificar as consequências do tipo de representação do negro construída e percebida na escola para o desenvolvimento da identidade étnico-racial dos alunos do Ensino Fundamental I. Para tanto, utilizou-se a (...) abordagem de pesquisa qualitativa, empregando o uso da modalidade pesquisa-participante e análise documental do Plano Municipal de Educação de Corrente-PI, município onde a pesquisa foi desenvolvida, Parâmetros Curriculares Nacionais e a Base Nacional Comum Curricular. A participação direta ocorreu por meio da realização de uma oficina de leitura realizada em uma turma do 2º ano do ensino fundamental, contemplando a literatura fornecida pelo PNBE, que versa sobre a construção da identidade étnico-racial. Diante da problemática e da dificuldade de implementação das leis que regem o ensino da temática, a pesquisa torna-se relevante, pois, longe de se esgotar a uma conclusão final, este estudo reforça a necessidade do constante debate e a busca por efetivação de práticas educativas que formem cidadãos emancipados e forneçam subsídios para os negros se autoafirmarem e para a valorização da cultura de matriz africana. Assim como a necessidade da busca por adequação, implementação, monitoramento e avaliação constante das leis que regem o ensino de história e cultura africana e afro-brasileira. (shrink)

A Ciência da Informação é cada vez mais convidada a encontrar caminhos para refletir sobre seu objeto como motor do desenvolvimento cultural e fortalecimento do mundo social da vida, de maneira a reafirmar seu lugar enquanto ciência social. Desse modo, a mediação da informação, estando presente em (...) todas as ações do ciclo informacional, constitui-se base sustentadora de ações que contribuem para que a Ciência da Informação cumpra com sua missão e responsabilidade sociais ante as ambivalências da sociedade. Assim, a teoria da ação comunicativa de Jürgen Habermas pode nos proporcionar um diálogo possível com as abordagens teóricas da mediação da informação, no sentido de encontrar pontos que convergem para eixos integradores do mundo social da vida. Nesse sentido, entende-se que o trabalho com a informação demanda pesquisadores e mediadores conscientes que, no âmbito da Ciência da Informação, desenvolvam e tomem como referência estudos da mediação da informação que envolvam esferas apontadas por Habermas como espaços em estado de vulnerabilidade. The main objective of this work is to understand the daily practices of user management in post-reformist devices in the Brazilian mental health field. Through Foucault's genealogical work on government practices, understood as forms of conducting the behavior of others, it is possible to open a possible field for the study of the practices of psi knowledge, considering them as forms of management that act by through the free and natural acts of individuals. More specifically, our goal is to examine (...) day-to-day practices on some reformist devices such as CAPS through user files. Basically, two driving models have been found in the new devices: 1) Cases with frank intervention of production of commitments and agreements with users, seeking the entry of this to varied activities and political leadership ; 2) Cases with little response from the user, in which the forms of conduction are implemented by policies of inclusion of family members and close reference characters in the management of the patient's life. Background: The new human coronavirus that leads to COVID-19 has spread rapidly around the world and has a high degree of lethality. In more severe cases, patients remain hospitalized for several days under treatment of the health team. Thus, it is important to develop and use technologies with the aim to strengthen conventional therapy by encouraging movement, physical activity, and improving cardiorespiratory fitness for patients. In this sense, therapies for exposure to virtual reality are promising and have been shown to (...) be an adequate and equivalent alternative to conventional exercise programs.Aim: This is a study protocol with the aim of comparing the conventional physical therapy intervention with the use of a non-immersive VR software during COVID-19 hospitalization.Methods: Fifty patients hospitalized with confirmed diagnosis of COVID-19 will be divided in two groups under physiotherapy treatment using conventional or VR intervention: Group A: participants with COVID-19 will start the first day of the protocol with VR tasks in the morning and then in the second period, in the afternoon, will perform the conventional exercises and Group B: participants with COVID-19 will start the first day with conventional exercises in the morning and in the second period, in the afternoon, will perform activity with VR. All participants will be evaluated with different motor and physiologic scales before and after the treatment to measure improvements.Conclusion: Considering the importance of benefits from physical activity during hospitalization, VR software shows promise as a potential mechanism for improving physical activity. O presente artigo tem como objetivo analisar a problemática inserida no discurso coaching alinhada à lógica neoliberal, o impacto deste pensamento na trajetória dos jovens em formação pelo Programa de Trabalho Protegido na Adolescência (PTPA) e de que modo esse discurso remodela os aspectos da subjetividade do sujeito em desenvolvimento. Para tanto contou-se com material de fonte primária obtido em atividade de pesquisa-ação denominada “Oficina dos Sonhos”, que contou com presença e participação direta dos adolescentes do PTPA que tiveram a (...) tarefa de pensar no local onde residem, como vivem e a perspectiva da transformação de modo lúdico e participativo. Assim, a oficina foi realizada pelo Observatório de Políticas Públicas para Adolescência, projeto de extensão da UERJ, e tornou-se relevante para compreender como a visão social e cultural do adolescente em diferentes contextos pode moldar a realidade dos sujeitos. Este estudo propõe, portanto, analisar a realidade do adolescente inserido na contradição do Estado capitalista, compreender limites, desafios e possibilidades de acesso ao primeiro emprego com condições dignas e tendo seus direitos garantidos, bem como a garantia à construção e continuação de projetos de vida. This note is a generalization and improved interpretation of the main result of Karni and Schmeidler. A decision-maker is supposed to possess a preference relation on acts and another preference relation on state-prize lotteries, both of which are assumed to satisfy the von Neumann–Morgenstern axioms. In addition, the two preference relations restricted to a state of nature are assumed to agree. We show that these axioms are necessary and sufficient for the existence of subjective expected utility over acts with state-dependent (...) utility functions and a subjective probability measure. Why is gauge symmetry so important in modern physics, given that one must eliminate it when interpreting what the theory represents? In this paper we discuss the sense in which gauge symmetry can be fruitfully applied to constrain the space of possible dynamical models in such a way that forces and charges are appropriately coupled. We review the most well-known application of this kind, known as the 'gauge argument' or 'gauge principle', discuss its difficulties, and then reconstruct the gauge argument (...) as a valid theorem in quantum theory. We then present what we take to be a better and more general gauge argument, based on Noether's second theorem in classical Lagrangian field theory, and argue that this provides a more appropriate framework for understanding how gauge symmetry helps to constrain the dynamics of physical theories. This article investigates the proof theory of the Quantified Argument Calculus as developed and systematically studied by Hanoch Ben-Yami [3, 4]. Ben-Yami makes use of natural deduction, we, however, have chosen a sequent calculus presentation, which allows for the proofs of a multitude of significant meta-theoretic results with minor modifications to the Gentzen’s original framework, i.e., LK. As will be made clear in course of the article LK-Quarc will enjoy cut elimination and its corollaries.

Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Free logics is a family of first-order logics which came about as a result of examining the existence assumptions of classical logic. What those assumptions are varies, but the central ones are that the domain of interpretation is not empty, every name denotes exactly one object in the domain and the quantifiers have existential import. Free logics usually reject the claim that names need to denote in, and of the systems considered in this paper, the positive free logic concedes that (...) some atomic formulas containing non-denoting names are true, while negative free logic rejects even the latter claim. Inclusive logics, which reject, are likewise considered. These logics have complex and varied axiomatizations and semantics, and the goal of this paper is to present an orderly examination of the various systems and their mutual relations. This is done by first offering a formalization, using sequent calculi which possess all the desired structural properties of a good proof system, including admissibility of contraction and cut, while streamlining free logics in a way no other approach has. We then present a simple and unified system of abstract semantics, which allows for a straightforward demonstration of the meta-theoretical properties, and offers insights into the relationship between different logics. The final part of this paper is dedicated to extending the system with modalities by using a labeled sequent calculus, and here we are again able to map out the different approaches and their mutual relations using the same framework. Frege's instantiation rule for the second-order universal quantifier makes his system, except for minor differences, full (i.e., with unrestricted comprehension) second-order logic, augmented by an abstraction operator that abides to Frege's basic law V. A few years ago, Richard Heck proved the consistency of the fragment of Frege's theory obtained by restricting the comprehension schema to predicative formulae. He further conjectured that the more encompassing Δ₁¹-comprehension (...) schema would already be inconsistent. In the present paper, we show that this is not the case. (shrink)

The Quantified argument calculus (Quarc) has received a lot of attention recently as an interesting system of quantified logic which eschews the use of variables and unrestricted quantification, but nonetheless achieves results similar to the Predicate calculus (PC) by employing quantifiers applied directly to predicates instead. Despite this noted similarity, the issue of the relationship between Quarc and PC has so far not been definitively resolved. We address this question in the present paper, and then expand upon that result. Utilizing (...) recent developments in structural proof theory, we develop a G3-style sequent calculus for Quarc and briefly demonstrate its structural properties. We put these properties to use immediately to construct direct proofs of the meta-theoretical properties of the system. We then incorporate an abstract (and, as we shall see, logical) predicate into the system in a way that preserves all the structural properties. This allows us to identify a system of Quarc which is deductively equivalent to PC, and also yields a constructive method of demonstrating the Craig interpolation theorem (which speaks in favor of the aforementioned predicate being logical). We further generalize this extension to develop a bivalent system of Quarc with defining clauses that still maintains all the desirable properties of a good proof system. (shrink)

The present paper is about the author’s current research on children’s education in urban contexts. It departs from the rising offer of programmes for school children in out-of-school contexts (e.g. museums, libraries, science centres). It asks what makes these practices educational (and not just interesting, entertaining and/or audience building). Based on Biesta ( 2006a , 2010 ) theory of education, the author frames and analyses the educational characteristics of, and possibilities of articulating, in and out-of-school educational practices. This paper aims (...) at understanding if the occasional outing from primary school premises promotes interruptions in the humanist foundations of school. In order to analyse relations between different institutions and professionals (to be) engaged in educational activities and programmes, Nóvoa ( 2002 , 2009 ) essays will be brought to the discussion, namely his conception of the ‘Public Space of Education’—as a space where culture, education, arts, sports and leisure are shared responsibilities, and where diverse institutions are networked aiming towards societal pluralism. I argue for the possibility of using cities’ public spaces as contexts with a worldly quality to complexify children’s education. Nevertheless, I draw attention to the unbearable educational lightness that these practices may carry if they do not go beyond the praise of chance; as well as to their unsustainable weight if they perpetually repeat school’s normal orders and add up rational discourses. Phenomenal particularism is the view that particular external objects are sometimes part of the phenomenal character of perceptual experience. It is a central part of naïve realist or relational views of perception. We consider a series of recent objections to phenomenal particularism and argue that naïve realism has the resources to block them. In particular, we show that these objections rest on assumptions about the nature of phenomenal character that the naïve realist will reject, and that they ignore the full (...) resources that naïve realism has to offer in explaining phenomenal character. The historical formation of Brazil is distinguished from the majority of ex-colonial nations by one factor that is especially characteristic: an intense process of ethnic and cultural mixing. The Portuguese colonisers, who, unlike the English Puritans in North America, left their families and arrived in Brazil in small groups mainly composed of men, naturally tended to pair off with the women they found available - first of all indigenous women and later African women. There was nothing in Brazil to prevent (...) this spontaneous behaviour similar to the role played in the English colonies of North America by the strength of the family group or the strict religious observance of the community. Thus from the outset Brazil tended to accept racial mixing as a de facto reality. As Gilberto Freyre correctly noted in his book Casa Grande e Senzala:They mixed happily with women of colour from the very first contacts and many mixed-race children resulted, so much so that only a few thousand men were enough to colonize vast areas and compete with the greatest and most numerous peoples as regards the extent of the colonial territory and the effectiveness of colonizing activity. Arguments analogous to those found in the late medieval theory of the king’s two bodies, popularized by Ernst Kantorowicz, were resurrected in early nineteenth-century constitutional theories of the moderating powers of monarchy. Post-revolutionary French liberal thought, echoed by its Portuguese counterpart, rediscovered the virtues of the institution of royalty, notably the immaterial and immortal body of the king. This rediscovery was prompted by the uncertainties of different national political contexts which made many contemporaries believe it desirable to integrate restored monarchies (...) within modern constitutional models for state stability. This first occurred with the Bourbons’ return to post-Napoleonic France and the restoration of the monarchy in 1814, and then with the Braganza royal family’s return to Portugal in 1821 after thirteen years of rule from Brazil. Using arguments similar to those previously made in late medieval European political and legal thought, French and Portuguese liberals developed a theory of the king’s two powers, according to which the monarch at once exercised a moderating power, defined by the abstract institutional nature of the king’s person, and an executive power, embodied within his physical person. This conceptualization of royal duality was intended to make it possible to delegate executive power to ministers, leaving the king only the attributes of a largely symbolic power. Liberals thereby hoped to confine the monarch to his purely institutional body in a de-politicized constitutional role. (shrink)

Aprender Matemática na escola é deparar-se com um mundo de conceitos que envolvem leitura e compreensão, tanto da linguagem natural como da linguagem matemática. Muitas vezes, os componentes curriculares, a Língua Portuguesa e a Matemática não dialogam. A resolução de problemas parece ser um dos pontos críticos na Matemática escolar. Este artigo aproxima esses componentes de forma a buscar estratégias para uma aprendizagem efetiva.

The analysis has identified the basic provisions of the fundamental principles and approaches on which the process of developing a project methodology for teaching students' conversational speech is based.

RESUMO De acordo com Bakhtin, o dialogismo polifônico, um princípio geral para que haja um avanço de conhecimento, é bem representado no romance literário e mais comumente em narrativas, nas quais diferentes “vozes” podem ser expressas. Assim, neste artigo analisamos narrativas baseadas em imagens e construídas por trinta crianças, entre 5 e 8 anos de idade, falantes de francês, narrativas essas produzidas antes e depois de uma conversa sobre as causas dos eventos. As análises tiveram como foco a habilidade das (...) crianças de fazer diferentes vozes serem ouvidas, particularmente as vozes dos personagens, as quais as crianças fizeram ser ouvidas não apenas por meio do discurso direto e indireto, mas também por meio de expressões dos seus estados interiores, como crenças, intenções e sentimentos. Os resultados mostram tanto um desenvolvimento da habilidade das crianças de fazer com que essas vozes sejam ouvidas em suas narrativas, quanto um papel facilitador da troca conversacional em suas expressões. The relative rate of success of parliamentary vs. governmental legislative initiative is quite different. The examination of one, resp. two full legislative term, for amendments, resp. bills introduced, shows thatparliamentary legislative initiative by far exceeds «regular» governmental initiative : in a ratio of 3 to 1 for bills, and of 4 to 1 for amendments. But the results are almost inverse : governmental initiative accounts for 76 % of the bills, and for 67 % of the amendments eventually voted. The (...) government succeeds in «pushing through» more than 90 % of its own initiatives, whereas parliamentary initiative hardly obtains an overall 10 % realization score. In an interrogative manner, the conclusion pointsto a few elements that may account for this situation. (shrink)

In the presence of incomplete risk attitudes, choices between noncomparable risky prospects are random. A random choice model advanced by Karni, 2021) includes the hypothesis that choices among noncomparable risky prospects are prompted by signals drawn from personal distributions. This paper introduces a scheme designed to elicit subjects’ assessments of their personal likelihoods of choices among noncomparable risky prospects and describes experiments designed to test the aforementioned hypothesis.
